New conditions for Temporary Protection

According to Art. 2 of the Council Implementing Decision (EU) 2026/1912: Temporary Protection shall be granted to those who satisfy their military obligations in Ukraine. At the moment, this means Member States need to verify the fulfilment of military obligations by male Ukrainian nationals aged 18-60.

According to Recital 18 of the Decision, a recent lawful crossing of the border upon leaving Ukraine or an exit stamp in the passport constitute evidence of authorisation to leave. Where lawful departure cannot be confirmed, the person concerned must submit additional documentation confirming either fulfilment with or an exemption from military obligations. Such documentation may include:
• a military registration document;
• documentation generated through the Reserv+ application;
• official documentation issued by the competent Ukrainian authorities demonstrating exemption from military obligations or compliance with such obligations.

The document needs to be accompanied by an accredited English translation.

IMPORTANT: persons who were granted Temporary Protection before the entry into force of the new eligibility criteria shall continue to retain their status and shall not be required to undergo this new verification process related to fulfilling their military obligations.
